Land Registration and Types of Land

 

Land registration is the system of recording rights and providing information and evidence concerning ownership. Types of evidence that can be registered include rent, sub-rent, conveyances, assignments, mortgages, gifts, power of attorney, etc. in relation to land

Land Registration benefits

  1. It enables you to invest in land
  2. It gives you access to credit facilities
  3. It proves and ensures the certainty of your ownership of the land
  4. It establishes your rights and interests in the land
  5. Your documents are admissible in court
  6. It clears land litigation

Types of Land

  1. Private or Individual land: This is land owned  by individuals and private entities
  2. Stool or Skin land: This refers to land under the custodianship of various chiefs
  3. Family land: This land managed by the Head of the family assisted by other principal members of the family.
  4. State or Stool vested land: This refers to land managed by the land commission

Before you go ahead to register land, it is advisable to follow due diligence to avoid land disputes. Confirm these two points before you go ahead with land registration.

  1. Make sure you are dealing with the rightful owner of the land. One who is recognized by law. You can conduct an official search in land records as well as make inquiries in the neighbourhood.  Do an original survey of the land to be sure the plan used for the search is for the exact land of interest.
  2. Engage the services of a qualified land surveyor. Only surveyors with licenses can legally undertake cadastral surveys.
